1. Service
TATA is a Kuwait-based platform intermediating between advertisers (merchants, brands) and influencers (food creators). We facilitate bookings, hold funds in escrow, generate contracts, and retain legal records.
2. Kuwait Decree-Law 10/2026
Every influencer registered on TATA must place the Arabic word "إعلان" at the start of any paid post. TATA embeds this reminder in the delivery form and signed agreement. Failure to disclose exposes the influencer to KWD 1,000–10,000 fines and up to 1 year imprisonment.
3. Licensing
Kuwait's media regulator requires influencers to hold an MOI/MOCI license. TATA collects this license within 7 days of first accepted booking and retains a copy for regulatory review.
4. Escrow & Payment
TATA holds the full contract value in escrow until the merchant approves delivered content. On approval, the influencer is paid net of TATA's 10% commission. If the influencer declines or fails to deliver, the merchant is refunded in full.
5. Disputes
Merchants may open a dispute within 72 hours of delivery. TATA admin reviews within 48 business hours; the decision is binding on both parties. Failing amicable resolution, either party may seek recourse in Kuwaiti courts.
6. Record Retention
TATA retains all contracts, transaction records, and platform events (including timestamps and party IPs) for at least five years per Decree-Law 10/2026.
7. Liability
Each influencer and merchant is liable for their own content before Kuwaiti authorities. TATA holds intermediary liability per statute but is not liable for individual disclosure or misleading content violations.
8. Amendments
TATA may amend these terms; the current version applies to future contracts, while existing contracts remain governed by the version the parties signed.
